Spousal Open Work Permit Canada.
Strategic guidance for spouses and common-law partners reviewing family open work permit eligibility through an eligible student, worker or in-Canada sponsorship pathway.
Know the Core Rules.
A family open work permit is available only in defined situations. The relationship, principal applicant’s category, current status and supporting documents must work together.
Genuine Family Relationship
Marriage or common-law evidence should show a credible, continuing relationship—not only a legal document.
Eligible Principal Applicant
The student, worker or sponsored partner must meet the current requirements of the specific open-permit category.
Valid Immigration Status
The applicant’s location, temporary status, maintained status or restoration position can affect how the application proceeds.
Complete Category Evidence
Study enrolment, occupation, permit validity, PR acknowledgement or other route-specific proof may be required.
Find Your Category.
Choose the situation closest to your family. This provides a preparation focus—not an eligibility decision.
Confirm the Study Program
Review the student’s valid permit, active enrolment and whether the master’s, doctoral, professional degree or named eligible program meets the current family OWP rules.
Build a Credible Case.
Before applying, connect the relationship, principal applicant’s eligibility, current immigration status and category-specific evidence.
Prove the Relationship
Show the legal relationship and the real history of the couple with consistent civil, financial, residential and communication evidence.

Prepare Your Family File.
Use this private checklist to see whether the relationship, principal applicant and immigration records are ready for review.
Check Permit Validity.
For the high-skilled worker family measure, the principal worker generally needs at least 16 months of work authorization remaining when IRCC receives the spouse’s application.
Follow Four Clear Steps.
A disciplined sequence keeps the family relationship, legal category, status and supporting evidence aligned.
Confirm the Route
Identify the exact student, worker or sponsorship rule supporting the application.
Build Couple Evidence
Organize civil documents and credible proof of the continuing relationship.
Protect Valid Status
Review location, expiry dates, maintained status and restoration before filing.
Submit One Story
Ensure every form, date and supporting record tells the same family story.
Compare Family Categories.
The evidence and timing change depending on whether eligibility comes through a student, a worker or an in-Canada sponsorship application.
Spouse of a Student
Eligibility is limited to spouses of students in qualifying master’s, doctoral, professional-degree or specifically eligible programs.
Program must qualifySpouse of a Worker
The principal worker’s occupation, authorization and remaining validity must meet the current family OWP measure.
TEER and validity matterSponsored Spouse in Canada
An eligible spouse or partner living in Canada may apply through the sponsorship public policy when the required PR stage and status rules are met.
AOR commonly requiredVerify Current Rules.
Family open-work-permit eligibility changed on January 21, 2025 and remains category-specific. Confirm the current student, worker or sponsorship instructions before submitting.
Avoid Common Assumptions.
A family connection does not replace the legal category. Confirm who qualifies, what evidence is required and when the family member may work.
Marriage Is Not Enough
A marriage certificate proves legal marriage, but additional evidence may be needed to establish a genuine continuing relationship.
Not Every Program Qualifies
Most spouses of college and undergraduate students no longer qualify unless the program falls within a specifically eligible category.
Not Every Job Qualifies
The worker route generally requires TEER 0 or 1 employment, or a listed TEER 2 or 3 occupation, plus sufficient permit validity.
Filing Is Not Permission
Submitting an application does not itself authorize employment. Work may begin only when lawful authorization exists.
